LEGAL SERVICES - FRANCHISING
Throughout
Australia, the range of businesses being franchised is on
the rise, as is the volume of sales through franchised outlets.
Regulation and legislative intervention
has also increased. There is now an "unconscionable conduct"
component to the Trade Practices Act, as well as a requirement
that Franchisors comply with a mandatory Code of Conduct.
These developments alone have had a significant impact on
the practices and procedures of all distributors of products
and services, particularly Franchisors and licensors.
We understand that Franchisors need to know:
- how current legislation affects the way
you do business
- how best to structure your affairs, and
- what documents and procedures need to be in place to ensure
compliance with legislative and Code of Conduct requirements.
We understand that Franchisees need to know:
- your legal rights
- assistance in understanding the terms of documents prepared
- by the Franchisor and in negotiating changes, and
-
how best to structure your affairs.
